The term "ius utendi" has origins earlier than the 16th century. It was common in the Franciscan poverty controversy of the 13th and 14th centuries. See, e.g., the papal bull of Pope Nicholas III, Exiit qui seminat (1279), and the ensuing controversy under Pope John XXII (1316-1334).

One also finds the term "ius utendi" in Roman law; e.g., Digest 7.6.5 pr. and Digest 43.20.5.1.
